Wrongful Death Verdict – Daycare Drowning

The Charges

In 2009, Clients’ 2 yr old son drowned in an above ground pool at his in-home daycare when the woman running the facility left him and 2 other young children unattended. It was determined that the daycare facility was operating illegally and the pool violated the Gwinnett County Pool Ordinance because it did not have a 4 ft fence around it, nor did it have any self-closing and self-locking gates on any of the openings in the fence.

The Result

After hearing the case, a State Court jury awarded $50,000 for pain and suffering and awarded the parents $9.8 Million for the wrongful death of their young son. The insurance company had an opportunity early in the case to settle for the policy limits but refused to do so. The verdict exceeded the disclosed policy limits by several million dollars and pre-judgment interest on the liquidated demand exceeds $900,000.

Wrongful Death Settlement – Trucking Crash

The Charges

Client was a passenger on the way to Florida traveling south on I-75 near Tifton, Georgia. A few miles ahead, an accident had just occurred when a car drove into the back of a tractor trailer, blocking one lane of traffic. Conditions that morning were foggy. As the client’s car came to a stop in the long line of traffic, a tractor-trailer loaded with waste dust came through a fog bank and plowed into the line of stopped cars, killing the client and four other people and seriously injuring several others.

The Result

Suit was filed against the driver, the truck company and the driver who had caused the initial accident, resulting in recovery for the client’s family.

Wrongful Death Settlement – Car Crash

The Charges

Client was a front seat passenger in a car that was making a left turn when it was t-boned by a car that drag racing with another car. The other car fled the scene. Client suffered fatal injuries.

The Result

After a thorough investigation of all three defendants, the client’s family decided to accept all of the available insurance coverage rather than file suit a re-live their pain.

Inadequate Security – Crime Victims

The Charges

Clients were sexually assaulted in a hotel rooms at the same hotel approximately 12 days apart.

The Result

In both cases a lawsuit was filed due to failure by the hotel to respond. After much feet dragging and filing suit, a successful recovery was made in both cases.

Trucking Crash – Shoulder and Head Injuries

The Charges

Client was a truck driver and while making a delivery he was struck by another tractor-trailer that ran a stop sign, causing client’s tractor to overturn. Client suffered injuries to his shoulder, leg and head. Client’s employer accepted his workers compensation claim as compensable and paid for all his medical treatment, including his shoulder surgery. His shoulder injury resulted in permanent impairment and the employer’s insurer chose to settle the claim.

The Result

The at fault driver and his company also chose to settle and waive any subrogation claim for benefits paid, resulting in client making a recovery for both his workers’ compensation and personal injury claims.

DUI Auto Collision – Aggravation of Neck Injury

The Charges

Client was in his car on the job when he was struck in the rear by a drunk driver who fled the scene and was later caught. Six months prior, client had undergone a 2 level fusion surgery in his neck. This crash aggravated that injury resulting client’s doctor having to perform another 2 level fusion surgery.

The Result

His employer accepted the claim as compensable; however, they later denied liability for the surgery because they believed his condition had returned to his pre-injury state. After a hearing was filed, the Employer elected to settle the case rather than litigate the issue. The policy limits from the drunk driver’s insurer, as well as the client’s UM policy limits were obtained without having to file suit.

Wrongful Death – City School Bus Accident

The Charges

Client’s six year old son was fatally injured when he was run over by his school bus. Our investigation determined that the bus driver had failed to follow procedure by visually counting all the children after they got off the bus and called her supervisor instead of 911.

The Result

After sending notice of the claim to the municipality involved, their attorney asked our client to accept the liability policy limits.

Rear End Collision – Aggravation of Back Injury

The Charges

Client was rear ended by defendant as he was driving home from work, suffering aggravation of a low back injury that resulted in multiple fusion surgeries. Client missed several months of work.

The Result

The defendant’s insurance company would not make a reasonable offer of settlement and suit was filed. The case settled during mediation a few days before trial.

Workers' Compensation – Knee Injury & Complications

The Charges

Client worked as a security guard and injured his knee when he fell down an embankment while making his rounds. He tore his meniscus and underwent surgery. He developed blood clots after the surgery requiring extensive treatment. His knee did not improve and he began to develop back problems due to altered gait.

The Result

A dispute arose regarding the causation of his back injury. The Employer/Insurer chose to settle the claim after the treating doctor opined that the back problems were related to the knee injury. Part of the settlement included the insurer setting aside funding for future treatment.

Workers' Compensation – Neck Injury

The Charges

Claimant worked as an HVAC Technician and suffered an injury to his neck during the course and scope of his employment, resulting in two herniated disks. He underwent a double fusion surgery, but continued to suffer from chronic pain and was unable to return to work.

The Result

The Insurer’s doctor determined that Claimant was permanently disabled as a result of his injuries. The Employer/Insurer requested mediation.
