Worker’s Compensation Claim

Our 55-year-old client worked as a low-wage gutter installer. While installing a gutter on an apartment building, the gutter came into contact with an electric power line and electrocuted him.  He survived but had serious electric burn injuries and disfigurement to his right arm and hand.  After a lengthy recovery, the worker’s compensation insurer settled the claim before a Hearing was held to determine if the injury was catastrophic.

Premises Liability Settlement

The victim was a longtime flight attendant who slipped and fell at the airport as he exited an escalator to board a train on his way home from working.  Rainwater flowed onto the indoor platform from under the station’s sliding doors that open when the train arrives.  He suffered a trimalleolar fracture to his ankle and never returned to his job.   A lawsuit was filed against the city landlord, the management company that oversaw the station, and the train operator. The case settled in mediation before trial.

Premises Liability Verdict

Our client suffered serious, life-changing injuries when she slipped and fell in a big box retail store. A pillow fell off the shelf behind her, and she inadvertently stepped on it, lost her balance, and fell backwards. In a heavily contested case and trial in which the court sanctioned the defendants for destroying evidence, the jury returned a verdict of $811,000 plus attorney’s fees and expenses.

Motor Vehicle Collision Verdict

Our client was a commercial truck driver who suffered a shoulder injury requiring surgery when a hit-and-run driver struck his parked tractor while he was in the sleeper of the cab. Before jury selection, the defense offered $125,000.  During the trial, the defense attempted to paint the client as a malingerer.  But during cross-examination, the defense’s own medical expert testified that he did not think the client was malingering.

Our client’s 83-year-old mother was killed in a T-bone collision with a commercial vehicle that was overloaded and had bad air brakes.

Dog Bite Verdict

Our client, an eight-year-old girl, suffered catastrophic injuries when two pit bulls attacked her after running from a nearby home. The dogs knocked her to the ground and repeatedly bit her, resulting in the amputation of her left arm and severe, permanent damage to her right arm. A DeKalb County jury returned a $72 million verdict, sending a strong message about the responsibility of dog owners to control and train dangerous animals properly.

Wrongful Death Verdict – Daycare Drowning

The Charges

In 2009, Clients’ 2 yr old son drowned in an above ground pool at his in-home daycare when the woman running the facility left him and 2 other young children unattended. It was determined that the daycare facility was operating illegally and the pool violated the Gwinnett County Pool Ordinance because it did not have a 4 ft fence around it, nor did it have any self-closing and self-locking gates on any of the openings in the fence.

The Result

After hearing the case, a State Court jury awarded $50,000 for pain and suffering and awarded the parents $9.8 Million for the wrongful death of their young son. The insurance company had an opportunity early in the case to settle for the policy limits but refused to do so. The verdict exceeded the disclosed policy limits by several million dollars and pre-judgment interest on the liquidated demand exceeds $900,000.

Wrongful Death Settlement – Trucking Crash

The Charges

Client was a passenger on the way to Florida traveling south on I-75 near Tifton, Georgia. A few miles ahead, an accident had just occurred when a car drove into the back of a tractor trailer, blocking one lane of traffic. Conditions that morning were foggy. As the client’s car came to a stop in the long line of traffic, a tractor-trailer loaded with waste dust came through a fog bank and plowed into the line of stopped cars, killing the client and four other people and seriously injuring several others.

The Result

Suit was filed against the driver, the truck company and the driver who had caused the initial accident, resulting in recovery for the client’s family.

Wrongful Death Settlement – Car Crash

The Charges

Client was a front seat passenger in a car that was making a left turn when it was t-boned by a car that drag racing with another car. The other car fled the scene. Client suffered fatal injuries.

The Result

After a thorough investigation of all three defendants, the client’s family decided to accept all of the available insurance coverage rather than file suit a re-live their pain.

Inadequate Security – Crime Victims

The Charges

Clients were sexually assaulted in a hotel rooms at the same hotel approximately 12 days apart.

The Result

In both cases a lawsuit was filed due to failure by the hotel to respond. After much feet dragging and filing suit, a successful recovery was made in both cases.
